Official rules

1. Sponsor

The SmartMatchApp Referral Giveaway 2027 (the “Giveaway”) is sponsored by SmartMatch Systems Inc., 4388 Saint-Denis Street, Suite 200, Montreal, Quebec H2J 2L1, Canada (the “Sponsor”). The Giveaway is not sponsored, endorsed or administered by, or associated with, Apple Inc.

2. Giveaway period

The Giveaway begins on November 1, 2026 at 12:00 a.m. Eastern Time and ends on August 31, 2027 at 11:59 p.m. Eastern Time (the “Giveaway Period”). The Sponsor's computer is the official timekeeping device.

3. Eligibility

The Giveaway is open to individuals and businesses that are registered participants in the SmartMatchApp Referral Partner Program (“Partners”), wherever they reside. Individual Partners must be at least the age of majority where they live. Where a Partner is a business, the prize will be awarded to the business's named account holder.

Employees, officers and contractors of the Sponsor, and members of their immediate families or households, are not eligible. The Giveaway is void where prohibited or restricted by law.

4. How to participate

No purchase or payment of any kind is necessary to participate. To take part, you must have a Partner account and be logged in to the SmartMatchApp referral portal:

• Existing SmartMatchApp clients log in at partners.smartmatchapp.com/referral/login to access their referral link and code.
• Everyone else creates a free referral account at partners.smartmatchapp.com/referral/register.

Partners then refer businesses to SmartMatchApp using their unique referral link or code, or by introducing them directly to the Sponsor's team.

5. Qualifying Referrals

A “Qualifying Referral” is a business that, during the Giveaway Period:

• is referred by a Partner through that Partner's referral link or code, or by direct introduction to the Sponsor;
• signs up for a paid SmartMatchApp plan; and
• by August 31, 2027, has either made at least two (2) monthly payments or one (1) annual payment to the Sponsor, or is still an active paying SmartMatchApp client on that date.

Former SmartMatchApp customers and businesses whose free trial has expired count as Qualifying Referrals when they sign up for a new paid plan. Each business counts once. If more than one Partner refers the same business, it is credited to the first Partner who referred it, according to the Sponsor's records.

The Sponsor may disqualify any referral, or any Partner, it reasonably believes involves fraud, fake or duplicate accounts, or payments made to inflate referral counts.

6. How the winner is determined

The prize will be awarded to the eligible Partner credited with the highest number of Qualifying Referrals at the end of the Giveaway Period, as recorded in the Sponsor's referral system. The Sponsor's records are final.

To be eligible to win, a Partner must have a minimum of two (2) Qualifying Referrals.

If two or more Partners are tied, the prize will be awarded to the tied Partner whose Qualifying Referrals represent the highest total net contract value. If two or more Partners are still tied after this, the prize will be awarded as cash only, and the $1,500 USD cash prize will be split equally among the tied Partners. If no eligible Partner reaches the minimum number of Qualifying Referrals, the prize will not be awarded.

7. Prize

One (1) grand prize is available: one Apple iPhone 18 Pro Max, 512 GB, in a colour of the winner's choice, subject to availability, or $1,500 USD in cash, at the winner's choice. Approximate retail value: $1,500 USD.

The prize is not transferable. No substitution is allowed except by the Sponsor, which may substitute a prize of equal or greater value if the advertised prize becomes unavailable. The winner is responsible for any taxes, duties and fees related to the prize. A cash prize will be paid by PayPal or bank wire transfer.

8. Chances of winning

The prize is awarded on performance, not by random draw. A Partner's chance of winning depends on the number of Qualifying Referrals they make compared with other Partners.

9. Winner notification and verification

The potential winner will be contacted by email at the address on their Partner account within 10 business days after the end of the Giveaway Period, and must reply within 14 days of being contacted. Before being confirmed as the winner, they may be required to:

• sign a declaration of eligibility and release;
• if resident in Canada, correctly answer a time-limited mathematical skill-testing question without assistance; and
• provide any tax forms required by law (for example, IRS Form W-9 for US residents).

If the potential winner cannot be reached, does not reply in time, is found ineligible or does not meet these requirements, the prize may be awarded to the eligible Partner with the next-highest number of Qualifying Referrals. The winner will be announced on September 30, 2027, or as soon as possible after that date if an alternate winner must be selected.

10. Referral commission

The Giveaway runs in addition to the SmartMatchApp Referral Partner Program. Commission earned on referrals, currently 20% of the referred client's net contract value for 12 months, paid monthly, is governed by the Referral Partner Program terms and is not affected by these rules.

11. Privacy and publicity

Personal information collected for the Giveaway is used to run it and to contact and verify the winner, in line with the Sponsor's Privacy Policy. With the winner's consent, the Sponsor may announce the winner's name and business name in its communications.

12. General conditions

By taking part, Partners agree to these rules and to the Sponsor's decisions, which are final on all matters relating to the Giveaway. Subject to applicable law, the Sponsor may modify, suspend or end the Giveaway if fraud, technical problems or other causes beyond its control affect its fair operation.

To the extent permitted by law, the Sponsor is not responsible for lost, late or misdirected referrals or communications, or for any loss or damage arising from participation in the Giveaway or from acceptance or use of the prize.

These rules are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. If there is any difference between these rules and any other Giveaway materials, these rules apply. These rules may be published in several languages. If there is any difference between versions, the English version prevails.
